3/1/83 Page -2- Councilman Cussen Referred to the incident report provided by the Police Department relative to the liquor license renewal and expressed concern regard- ing the disturbance incidents not reported by the establishment. Attorney Rautenstraus advised the first in- cident should have been reported as it was a verified disturbance ; however the last one was not as there was not sufficient evidence. Pertinent to the second incident listed on the report , the officer suspected this occurred, therefore issued a warning. Had there been sufficient evidence in any of the incidents the parties involved would have been charged in Municipal Court. Councilman Cussen stated he felt these were serious and should it occur in the future at this establishment , council should con- sider a 3-5 day suspension of the liquor license. APPROVAL Question called for on the motion. All in favor. Motion carried unanimously. BLACK DIAMOND SALOON - REQUEST Attorney Rautenstraus advised this request TO ALTER PREMISES was a follow-up on the liquor license for modification of premises. The special review use and P.U.D. was approved at last council meeting. No public hearing required. APPROVAL Councilman Ferrera moved, Councilman Cummings seconded that the Black Diamond Saloon request for modification of premises be approved. Question called for. All in favor. Motion carried unanimously. STORER CABLE T.V. - DISCUSSION Rod Dagenais, Area Manager , for the state PENDING TRANSFER OF OWNERSHIP of Colorado for Storer Cable TV, stated he received this post when Joe Tennessen resigned. He advised that Storer Cable TV is considering the possible transfer of ownership to Scripps-Howard. Mayor Meier Commented he wished Scripps-Howard to supply council a package of the services that would be available , as well as compliance with the franchise held by Storer. Mr. Dagenais advised he did not have such a package available at this time - did know that Scripps-Howard will be serving Longmont and Lafayette and presently are serving some cities in California. Florida and Connect- icut .
