Motion
carried unanimously.
COUNCIL ITEMS Kim Burch, 177 Griffith St. stated that he
KIM BURCH - STREET CLOSURE wished to have a block party August 6, 1983
in the daylight hours on Griffith Street and
he was requesting the closure of Griffith
St. between Monroe and Wilson Streets. He
had solicited several of the residents in
the area and everyone was in approval of the
party. In his letter he requested the City pro-
vide ordinances pertaining to live music and
alcoholic beverages. Noted from the City
Municipal Code that he had to have a special
permit for a live band at the residence. He
had asked for the ordinances two weeks ago
and was just handed the information this
evening; therefore wished more clarification.
Must Obtain Special Permit Attorney Rautenstraus advised that the ordin-
for Live Band ance was adopted approximately 2 years ago
which provides that a permit is required for
what is called a live musical performance. This
would include a live band with a loud amplified
system. To obtain a permit you must appear
before Council at a public hearing - notice
given to the surrounding area of the proposed
performance; must pay an application fee.
After the public hearing Councilmembers deter-
mine: if it is appropriate to approve the
application.
Mr. Burch noted that the process takes 30 days.
Rautenstraus advised within 30 days of the
application Council sets the hearir it
woele ^^t ':;:. ; lieee possible to have the public
hearing this evening because notice could not have
been given to the neighbors.
Street Closure Inquired if he Could have approval then on the
street closure.
Mayor Meier advised that Council would vote
on this after his remarks had been presented.
He then informed Mr. Burch the City had had
problems previously with loud live bands and
that was why this ordinance was adopted. It
wasn' t that councilmembers doubted that he
had contacted all his neighbors, but perhaps
one a blcok away may not have been informed.
Therefore if a public hearing was held everyone
would have an opportunity to attend. Apologized
for the tardiness of the information being
given him.
