0 !
Be further stated, 'It is a pleasure to be in a
position to vote for wildlife, to vot• for
continued grazing in areas adjacent to the
community.' The implication that this ordinance
is gutting the citizen's initiative petition I
find to be a reaction and I don't think its a
statement or an opinion that is based on a careful
analysis of what this ordinance purports to do. I
would urge Council to vote in favor of the motion
on the floor." The ordinance was adopted
unanimously by roll call.
ORDINANCE 8858 -
VEHICLE PARKING POLICY Mayor Meier opened the Public Rearing on Ordinance
8858. Rautenstraus read by title only Ordinance
#858, "An Ordinance regarding the ticketing and
towing of vehicles parked on private property."
The ordinance was properly published in its
entirety May 8, 1985, and notice of Public Nearing
was published May 15 and 22, 1985.
Mayor Meier asked for public comments in favor or
in opposition to Ordinance 8858. None.
Mayor Meier asked for Council questions and
comments. Morris asked what had changed in the
wording of the ordinance since the initial
presentation to Council. Rautenstraus related
that some wording had been deleted regarding
'stopping or parking". The word 'stopping" had
been deleted. Other ordinances from other
municipalities had been reviewed and it was
determined that the wording of this ordinance was
the standard mode of operation in setting up an
ordinance regarding this issue. Also reviewed
were remedies that an owner of a vehicle might
have if the ordinance was abused and determined
that there was potential for an owner of a towed
vehicle to seek to protect themselves from
capricious acts.
Morris' concerns were with regard to the
coordination of towing fees so that there would be
a set charge to protect a person from being
charged more than another. Rautenstraus said that
the charges were governed by the market and that
there were not many towing companies in the
immediate area. It would be difficult to
accomplish anything without entering into the
position of regulating rates.
Morris related that this had been a major issue in
Boulder and in fact two vehicles towed from the
same place could conceivably be charged two
different rates depending on which towing company
6
