a tool to be used to guide us in raking decisions,
but mos it is hade, doesn't moan that it has to
be cast in concrete. Jot everyone else in the
world is going to honor our Comprehensive Plan.
They will do whatever is best for their City and
that is the saee thing we should do.*
Mayor Pauses asked staff if the conditions spelled
out in the pr auuouatiaa agreement were
agreed to by tpproperty owners. Manual stated
that they were agreed to by the applicants.
Mayor "'mason closed the public hearing and called
for further Council discussion.
Szymanski asked if the one conditions spelled out
by the Planning Commission regarding the buried
storage should in fact be specified as adequate
storage. This would then include any type of water
storage needed and thus not limiting it to buried
storage. Staff and Council concurred.
Also Szymanski referenced the condition of the
35' limitation. Manusb explained that the
building code has • 50' limitation in a CM zone.
Planning Commission had* this condition so as to
be consistent with the height restriction for the
Monart Development as this is a major entrance to
the City that should have the vier unobstructed.
Ssyianski felt that the City should consider
having this sane restriction on the south side of
Q.B. 36 as well as the north side.
With no further discussion, Mayor tauson coved
that Ordinance #906 be adopted with the six
conditions specified by the Planning Commission
and reword Condition IS to read *adequate
storage*. Mohr seconded. By Moll Call Vote,
Ordinance #906 was unanimously adopted.
OBDIMAMCZ #907 •- BINLIAMOOLICZ JUMIXA?ZON II
PUBLIC BEARING kautenatraus read by. title only Ordinance #907.1
*An Ordinance annexing to the City of Louisville,
Colorado, a parcel of approximately 33.15 acres
located south of O.S. &ighray 36, in Section 19
which is owned by Richard P. &Lelia.' Proper
publication and notice of public bearing were
established.
Mayor Pauson opened the public firing.
Wanush briefly described the parcel in the
annexation request and asked that his consents
made during the presentation of Ordinance #906 be
a natter of record for this Ordinanoe as well.
9
