Council
directed City Attorney Curt Mautenstraus to draft
such an ordinance. The Historical Co*aission and
City staff find the Ordinance and Lease Agreement
acceptable and recommend approval.
Mayor Fauson asked for anyone wishing to spook in
favor of or in opposition to the ordinance. none.
Szymanski stated that this is en important step in
preserving the City's heritage.
Mayor Pauson closed the public hearing and called
for a notion. Mohr moved that Ordinance #905 be
adopted. Ssymanski seconded. By Roll Call
Vote, Ordinance #905 was passed unanimous.
ONWIMMCH 4906 - intuAlicanacit AM'MEXATIOH Z ..
PUBLIC RHARI O Pautenstraus read by title only Ordinance #906,
An Ordinance annexing to the City of Louisville,
Colorado, a parcel of approximately 33.39 acres
located north of U.S. Highway 36, in Section 19,
which is owned by Richard P. Stella.' Proper
publication and notice of public hearing wore
established and Mayor Pauson opened the public
hearing.
Handley reviewed the proposed annexation and
commented on the following concerns expressed
during the Planning Caemcis, sion public hearings
1) The existence of an agreement between
Louisville/Superior to provide service; 2) The
observation that nothing has changed since the
1982 *Jolla Annexation vote; and 3) Concern over
aesthetics of the interchange. •A.
Handley stated that with regard to the issue of
the aaeaadsent (addendum) to the water agreement,
he and the City Attorney have researched this
issue and find that no such agreement exists.
Superior never signed an agreement wherein the
Louisville City Council included language limiting
either community from proving utility services to
the other side of the turnpike. Prom May 1983 to
August 1984, former City Administrator, Leon Mnrl,
attempted to get Superior approval of this
addendum without success.
2
. • a 11cire.,er
