.
Louisville did agree to this Agreement in 1982 and
this Council will continue to honor this Agreement
in its original fora. Mayor lauson stated that
staff could continue talks with Superior to see if
there are any areas of negotiation. However, the
consensus is that Council is not interested in
negotiating a whole new agreement with the Town of
Superior.
Sackett stated that if it is at all possible to
give Superior some sort of feel for or sons type
of method by which to do planning for their City
that would be beneficial to Superior. he would
like to see Louisville pursue that.
Mohr stated that the 1982 Agreement was arrived at
by both the Town of Superior and the City of
Louisville at that time. It in difficult for the
City of Louisville to state exactly when the
Howard Berry Treatment Plant will be on line
because it is contingent on a lot of things. 'The
Howard Berry Plant is one of these consideration
which at this point is not necessarily a
priority...and quite frankly, the Water Agreement
we agreed to in 1982...was at the request of
Superior.• •There are no surprises about that.
There should be no surprises about 1991...or
anyother date. There is nothing in the Agreement,
as I read it, which indicates that any of those
are significant tines.• *How do we know when we
are going to build that until our analysis
indicates that we should do that?"
Sackett asked if there was any way Louisville
could accommodate Superior prior to the Howard
Berry Plant. •I would like to ask the staff to
explore if there is a way for us to assist
Superior without the Howard Berry Plant and
without jeopardising our own water situation. '
Ms. Bolston stated that the original Agreement
refers to the construction of facilities at a
location north and west of the Town of Superior.
It doesn't mention the Howard Berry facility
verbatim. Given that the City of Louisville is
planning the construction of a water storage tank,
M. Holston suggested that might constitute the
improvements north and west of the Town of
Superior. Ms. Belston asked if the tank could
take the place of the Howard Berry facility that
the Agreement probably eluded to in 1982 and if
so, when could Superior hook up to water service.
Bundley stated this could be taken under
advisement. It would be necessary to consider the
11
