Carnival expressed similar concerns and asked why <br /> going on line in 1991 would hinder Superior's <br /> efforts in applying for the CDBG funds. "We have <br /> an agreement with you. You know the particulars <br /> of that agreement. Can't you proceed with that?" <br /> Ms. Holston replied stating that Superior is <br /> proceeding with the grant application and if <br /> approved the transmission and system and <br /> transmission line would probably be completed in <br /> 1908. However, if one of the conditions of <br /> attaching to Louisville is that the Howard Berry <br /> Treatment Plant be on line, and if that isn't <br /> going to happen until 1991, Superior would not be <br /> able to accept the State's money at this. <br /> Anderson asked what Superior's interpretation of <br /> the 1982 Agreement was. <br /> Ms. Holston stated that it was their interpreta- <br /> tion that all Superior would need to do is attach <br /> to the 18` line already stubbed in at Dillon and <br /> McCaslin and run the line south, bore under the <br /> highway and set up a distribution system in <br /> Superior. Ms. Hesston stated that no mention has <br /> been made that Superior would have to wait until <br /> the new plant was on line. <br /> Hundley stated that the original Agreement <br /> clearly references water treatment facilities at <br /> the approximate location of the Howard Berry <br /> plant. Hundley did indicate that he would be <br /> happy to present this issue to Council. In dis- <br /> cussions between Eundley and Ms. Ballston and <br /> Superior Board Members, alternatives were dis- <br /> cussed that Superior felt were needed from the <br /> City of Louisville. Hundley, stated that before <br /> taking any proposals to Council, Superior should <br /> have something specifically in writing. However, <br /> in Bundley's opinion, many things have changed <br /> since that time, i.e., the Rock Creek Ranch has <br /> been annexed to Superior and the proposed <br /> amendments are a substantial departure from <br /> requests of six or seven changes discussed pre- <br /> vious to the Rock Creek annexation. <br /> Mayor ?mason stated that he was on Council during <br /> the drafting of the original Agreement and that <br /> Council made it very clear that Louisville should <br /> not be in the business of selling water.
