that all water rights obtained by Superior pursuant
to the Water Rights Dedication Ordinance be turned
over to Louisville; and 8) Superior has also
deleted the language requiring that the only water
supplied within the corporate limits of Superior
rust cons from Louisville.
Ms. belston stated that it is her understanding
that Louisville's proposed Howard Berry Water
Treatment Plant will not be on-line until 1991.
It has been â– ade clear that Superior will have
to wait until 1991 when the new water plant is
built. It has been Superior's understanding that
all Superior has to do is attach to an 18" line
stubbed in at Dillon and McCaslin, run a trans-
mission line under the highway and install a dis-
tribution system in order for Superior to be
supplied with water according to the 1982 Water
&grssnent. It was even suggested that Superior
apply for a grant this year that would enable this
process to take place. Wow, it appears that they
will have to wait at least until 1991 to hook up
to Louisville's system.
Ms. Belston said, '...what you its before you is
the optimal type of agreement that Superior would
like to see. Of course we are trying to make sure
that the people of Superior are best served. I
believe that Louisville would also do the sane for
its people. We are willing to compromise on some
of these items.' 'If none of these changes are
agreeable, does our 1982 Agreement as written and
signed still stand, and if it does still stand, in
what year would be the earliest opportunity that
the Town of Superior would be able to hook up to
the Louisville system."
Dave Stahl, representing Bogart Development, 400
So. McCaslin, asked to speak regarding this
request. !!r. Stahl stated that eonart has a
concern that prior to Louisville approving any
additional commitments for utility service outside
the existing City limits, it would seem
appropriate that the water distribution study that
was done in 1979, updated in 1985, be updated
again. With all the additional commitments in the
City of Louisville since that latest update, i.e.,
the health care park, the Biella-Menkick property,
etc., and also the fact that the infrastructure is
in place in the southwest part of the City, it
would seem appropriate to conduct some studies
incorporating these additional commitments prior
to negotiating arty additional commitments outside
Louisville's corporate limits.
6
