Scott Carlson, owner and developer of Rock Creek <br /> Ranch, stated that past and future history of <br /> Superior and Louisville are tied together. <br /> Superior's major concern at this point is how can <br /> the original residents of Superior get water <br /> service. There has been an existing contract in <br /> place since 1981 and as with any contract is open <br /> to interpretation. "As a property owner in <br /> Superior, what we would like to have is some type <br /> of understanding, some type of agreement or pro- <br /> came by which we can move forward to get water <br /> service to the original residents of Town, not to <br /> my project. l don't think the contract even as <br /> amended envisions service to Rock Creek Ranch in <br /> total because the scope of the infrastructure will <br /> not currently handle the area. I would like at <br /> some point in time work with your staff and <br /> Council to talk about regionalization of utilities <br /> with Rock Creek Ranch paying our fair share and <br /> helping to upgrade the facilities in the entire <br /> Coal Creek, lock Creek, Basin.' 'We would like to <br /> have some type of clear direction, some type of <br /> process that we can enter into that would get us <br /> from where we are to where we need to be and where <br /> we need to bierater for 250 residents in the Town <br /> of Superior so they can have an increased quality <br /> of life...• <br /> Mohr stated that it is clear to him that during <br /> the negotiations of the original 1982 Water Agree- <br /> ment with the Town of Superior both parties had <br /> something to bring to the table -- the City of <br /> Louisville was in need of a sewer agreement with <br /> • the Town of Superior and Superior *wanted to ensure <br /> that sometime in the future they may have access <br /> to water without having to go into the investment <br /> themselves. "It seems to me that we have somewhat <br /> of a problem and this is not so much a <br /> modification of our existing Agreement as it is a <br /> proposal for an entirely new agreement. Most of <br /> the articles...speak to changing the content, the <br /> substance of that Agreement in its entirety and <br /> the real question that I hays to ask of <br /> myself...what is it you bring to the table for us. <br /> You are asking us to change everything as I read <br /> it to your favor.' <br /> Ms. Balaton responded stating that what the Town <br /> of Superior has to offer the City of Louisville is <br /> 8800,000 in tap fees. Beyond that if there are <br /> any ideas that Louisville would like to propose, <br /> the Town of Superior would consider those <br /> proposals. The Town Board is fully aware <br /> that Louisville will most likely want to negotiate <br /> in the proposed amendment. <br /> 7 <br />
