Anderson roved that Council approve Resolution 49,
Series, 1967. Mayor Pauson seconded. Unanimous.
RESOLUTION 010 - COLA c: IR CEMETERY
SUBDIVISION Rautenstraus read in its entirety Resolution 010,
Series 1967, 'A Resolution approving a final plat
for Coal Creek Memorial Cemetery.'
Wanush stated that Coal Creek Memorial Cemetery
Inc., represented by Cliff Brock, requests a two-
lot subdivision of the 12.02 acre parcel located
at 1751 Highway 42. The applicant requests two
lots: Lot 1 is 5.053 acres and lot 2 is 6.973
acres. The property is soned agricultural and
used as a private cemetery. The request conform'
with the minimum lot area allowed in this sone (5
acres). No 9UD is required. All existing
agreements would remain in effect. Any
development will be subject to building department
requirements. Planning Commission recommended
approval at the public hearing on April 14, 1947.
Anderson asked if access to the property from
Righway 42 would be affected in anyway. Wanush
stated that the State Highway Department issued an
access permit in 1902 and they feel at this time
there is no need for an additional acceleration
lane. when the average daily traffic onto the
property exceeds 50 vehicles per day, they would
then require the applicant, at the applicant's
expense, to make those improvements. This would
be monitored and enforced by the State Highway
Department.
Anderson questioned the wording *Second Replat` on
the plat to be filed with the County Clerk.
Rautenstraus stated that there are different
statutes that relate to cemeteries and that staff
would look into the matter to be sure that 'Second
Repute is an accurate term before such documents
are filed.
Mohr moved that Resolution 10, Series 1987, be
approved. Scarpella seconded. Unanimous.
RESOLUTION 411 - 11-470 AUTHORITY INTERGOVERNMENTAL
AGREEMENT Rautenstraus read in its entirety Resolution 011.
Series 1947, 'A Resolution authorising the City of
Louisville to enter into the 11470 Authority
Intergovernmental Agreement.•
fwndley stated that representatives of Louisville
have met with representatives of other local
governments in the 11-470 corridor in recent months
to discuss the establishment of a M-470 authority.
7
