Wanush explained that the applicant is requesting <br /> the annexation of a two acre parcel located at 8330 <br /> Cherry Street. The Planning Commission reviewed the <br /> annexation proposal and found it to be in compliance <br /> with State statues and City ordinances. They <br /> recommend that the Council approve the annexation <br /> subject to the following conditions: 1) the parcel <br /> be developed under a single PUD; 2) the development <br /> be consistent and compatible with surrounding <br /> development guidelines; 3) all water rights be <br /> dedicated; 4) 12% of the land be dedicated or cash <br /> in lieu (Wanush recommended cash in lieu since <br /> there is no foreseeable use for public land on that <br /> 2 acre site) ; and 5) service expansion fees be paid. <br /> Don Shonkwiler, McCormac Development, 720 Burbank, <br /> Broomfield, stated that wanush's presentation of the <br /> request was complete. Mr. Shonkwiler reminded <br /> Council that at the Louisville Futures Conference, <br /> it was determined that a high priority was <br /> affordable property for attracting businesses to <br /> Louisville. Mr. Shonkwiler feels that this property <br /> will offer that to the business community. <br /> Mayor Fauson asked for anyone wishing to speak <br /> either in favor of or in opposition to Ordinance <br /> #930. None. <br /> Mayor Fauson closed the public hearing and called <br /> for a motion. <br /> Mohr moved that Ordinance 11930 be adopted on final <br /> reading. Mayor Fauson seconded. By Roll Call Vote, <br /> Ordinance 11930 was adopted unanimously. <br /> ORDINANCE *931 - ZONING - RICHMOND PROPERTY - <br /> PUBLIC HEARING Rautenstraus read by title only Ordinance #931, "An <br /> Ordinance amending Title 17 of the Louisville <br /> Municipal Code entitled "Zoning" by zoning property <br /> or approximately 2.0 acres owned by Lynda K. <br /> Richmond." Proper publication and notice of public <br /> hearing were determined and Mayor Fauson opened the <br /> public hearing. <br /> Wanush stated that Council is being asked to zone <br /> the property Commercial-Business (CH). The property <br /> is surrounded on two sides by Homart's Parcel 0, <br /> their highest density Parcel. The Planning <br /> Commission reviewed this and recommends the CH <br /> zoning. Wanush asked that his comments regarding <br /> the Richmond annexation during the proceeding Agenda <br /> Item be considered as part of the record for this <br /> Agenda item. <br /> • 2 <br />
