that the annexation of the Menkick West property can <br /> proceed as originally planned. A copy of <br /> Louisville's response to Superior's filing in <br /> District Court was given to Council prior to the <br /> meeting and City Attorney Curt Rautenstraus will <br /> respond to any questions Council may have regarding <br /> the document. Hundley commended Rautenstraus for <br /> drafting a well written response to Superior's <br /> filing. <br /> Mayor Fauson asked if anyone would like to go into <br /> an Executive Session to discuss negotiations and/or <br /> legal aspects on this issue. The consensus was that <br /> it was not necessary at this time. <br /> Szymanski asked if a time frame could be determined <br /> if this issue does go to District Court. <br /> Rautenstraus stated that the Court would establish a <br /> time frame and that this type of procedure doesn't <br /> happen often, therefore, the Court does not have a <br /> specific procedure established. However, <br /> Rautenatraus predicts that this will become a <br /> priority on the Court calendar. <br /> Szymanski asked if the City is still engaged in <br /> negotiations with Superior. Rautenstraus and <br /> Hundley assured Council that negotiations are still <br /> being sought with Superior, however, they have <br /> indicated that there are some other issues where <br /> they don't feel they can come to a basis for an <br /> agreement at the present time. <br /> Szymanski stated that it is in Louisville's best <br /> interest to proceed with the action in District <br /> Court, but that from a "gentleman's point of view,' <br /> Louisville should continue to do whatever can be <br /> done to try to negotiate with Superior and reach <br /> some kind of agreement with them regarding this <br /> issue. <br /> Mayor Pauson moved that Resolution 822 be continued <br /> to the October 20, 1987, Council Meeting. Szymanski <br /> seconded. Unanimous. <br /> Rautenstraus recommended that the next two Agenda Items, Ordinance 8937 and <br /> Ordinance #938, not be considered tonight as Resolution #22 will need to be <br /> resolved prior to consideration of these two Ordinances. Both Ordinances <br /> will be considered at the time Resolution #22 is adopted. <br /> ORDINANCE 8937 - MENEIC ( WEST AN1EEXATION - 1ST READING - <br /> SE? PUBLIC HEARING Delayed.
