Staff recommends the award of bid to Diamond <br /> Constructing Corp. in the amount of $824,037.25 and <br /> recoanond that the Mayor and City Clerk be <br /> authorised to sign the contract documents on behalf <br /> of the City. <br /> Mayor Fauson moved that Council award Diamond <br /> Contracting Corporation the contract for the Treated <br /> Muter Storage project pipeline at their low unit <br /> price bid of $824,037.25. The subdivider at the <br /> time was R.B. Development Company who was purchasing <br /> the ground from Roaart. A subdivision agreement was <br /> negotiated and signed with A.S. Development but the <br /> purchase of the property frog locart was never con- <br /> summated. Subsequently, Homart has requested some <br /> chanaas in the agreement. Specifically, that have <br /> asked that the tot lot ne removed from the plan and <br /> that the City pay for sod and irrigation in the <br /> entire drainage area. A draft agreement has not <br /> been received. Rundiey stated that Dave Stahl, <br /> Soaart Development Corp. is present to answer ques- <br /> tions and concerns. <br /> Dow Stahl, Rosart Development Corp., addressed <br /> Council stating that Bogart has decided to move <br /> !onward and do the lot development of Cherrywood <br /> Subdivision in two phases. The first phase will be <br /> 60 lots adjacent to Cherry Street, east of the <br /> Centennial Center. W. certainly recognise the <br /> obligations - commitments that RS Development cad* <br /> when he processed the p1st, but they have been <br /> unable to successfully move forward, and Smart <br /> Development Company, as the owners, decided to now <br /> move forward and develop the lots. And we have mad* <br /> a couple of requests of the City which to date I <br /> think we've been unsbl to resolve. I'm not sure <br /> there is a clear cut answer as of today...and our <br /> request this evening is not to ask for a determina- <br /> tion on whether or not the detention area should be <br /> sodded and have an irrigation system and whether or <br /> S <br />
