He asked the applicant <br />if he would be agreeable to a condition that light from the parking lot fixtures not shine onto <br />McCaslin. <br /> <br />Karis replied that he would be. <br /> <br />Sisk asked the applicant if he was aware that this property is subject to the McCaslin Interchange <br />Improvements and whether he would be agreeable to placing that condition on this PUD. <br /> <br />Kads replied that he was aware of the proposal and would be agreeable to placing that condition on <br />this PUD. <br /> <br />Mayer moved that Council approve Resolution No. 52, Series 1998, Final PUD Development Plan <br />for Fan's Bar & Restaurant, 269 S. McCaslin Blvd, (Lot 9A, Century Office Park) as presented plus <br />the following conditions: that a joint parking agreement be entered into between Fan's Restaurant <br />and Heritage Bank, that frosted or tinted glass be allowed on the windows on the west elevation, and <br />that the applicant agree to the McCaslin Interchange Improvements proposal, seconded by Sisk. <br /> <br />Sam Light, City Attorney, offered a friendly amendment that the interchange condition would read: <br />that the applicant/owner would agree to formalize the commitment to participate in possible future <br />funding of McCaslin Interchange Improvements including acknowledgment that they would not <br />protest inclusion in a potential special improvement district on grounds that their property does not <br />benefit from such improvements with language to be incorporated onto the PUD and in a developer's <br />agreement that is subject to approval by the City Attorney, City Administrator and Mayor. He then <br />offered a friendly amendment that the parking agreement condition read: that a shared parking <br />agreement allowing for overflow parking with Heritage Bank be provided at or prior to recording <br />of the Final PUD. Amendments accepted by Mayer and Sisk. <br /> <br />Roll call was taken. Motion passed by a 6-0 vote. <br /> <br />RESOLUTION No. 53, SERIES 1998, APPROVING AN AGREEMENT FOR THE <br />FUNDING OF IMPROVEMENTS TO THE INTERSECTION OF DILLON ROAD AND <br />96th STREET <br /> <br />Howard asked that he be excused from this discussion as he is an employee of Storage Technology. <br /> <br />Davidson agreed. <br /> <br />Davidson called for staff introduction. <br /> <br />Tom Phare, Public Works Director, stated this is the final form of the agreement to cost share with <br />STK for improvements to the Dillon Road and 96th Street intersection. The agreement has been <br />reviewed by the City Attomey as well as legal counsel for STK. Approval of the agreement will <br /> <br /> <br />
