<br /> RESOLUTION NO. 18 <br /> Series 1988 <br /> A RESOLUTION AUTHORIZING THE CITY OF LOUISVILLE, COLORADO <br /> TO ENTER INTO THE W-470 HIGHWAY AUTHORITY AGREEMENT; <br />AND RATIFYING ACTION HERETOFORE TAKEN IN CONNECTION THEREWITH <br /> WHEREAS, the City of Louisville, Colorado (the "City") and <br />certain other political subdivisions of the State of Colorado <br />identified in the W-470 Highway Authority Agreement dated as of <br />May 16, 1988 (the "Agreement") (the City and the other political <br />sUbdivisions identified in the Agreement are referred to col- <br />lectively as the "Members") have the authority to enter into the <br />Agreement to create a public highway authority to finance, <br />construct, maintain and operate a highway, more specifically <br />described as a portion of a beltway generally circumscribing the <br />northwestern portion of the Denver Metropol i tan Area, commonly <br />referred to as "W-470"; and <br /> WHEREAS, W-470 has been proposed for construction through <br />the northwestern portions of the Denver Metropolitan Area within, <br />or located in proximity to, the geographical boundaries of the <br />Members; and <br /> WHEREAS, cooperation among the Members with respect to <br />financing, constructing, maintaining and operating W-470 would <br />make the most efficient and effective use of the powers and <br />responsibilities of the Members, would serve the public interest, <br />and would benefit the health, safety and welfare of the residents <br />and taxpayers of the Members and the State of Colorado and the <br />users of W-470; and <br /> WHEREAS, pursuant to 43-4-501 et ~, Colorado Revised <br />Statutes, as amended, (the "Public Highway Authority Law") , <br />Article XIV, Section 18(2) of the Constitution of the state of <br />Colorado and Section 29-1-201 et ~, Colorado Revised Statutes, <br />as amended, the Members may cooperate or contract with each other <br />to create a public highway authority under the Public Highway <br />Authority Law; and <br /> WHEREAS, on April 20, 1988, pursuant to 43-4-504(3), C.R.S. , <br />notice of this public hearing was published in the Louisville <br />Times, and the Agreement has been properly presented to the City <br />Council; and <br />
