<br /> ..,. <br />PROCLAMATION - "ARBOR WEEK" - LOUISVILLE PARKS & RECREATION <br /> Mayor Fauson declared April 15-20, 1991 as "ARBOR <br /> WEEK" in Louisville. <br />BXBCUTIVB .BSSIOB <br />Mayor Fau.on moved to go into an Executive Session to receive informa- <br />tion from Attorney involving pending litigation, seconded by Carnival. <br />Motion passed 6-1 with Howard voting no. <br />Fauson: Discussion on Executive Session was on pending <br /> litigation. Any further information needed by the <br /> press, address the City Attorney after council <br /> session. <br />Griffiths: For information of those who are here, we did <br /> discuss three (3) lawsuits pending against the <br /> city. Lazuk, Leehman cases and the case of the <br /> Town of Superior and the City of Louisville. <br /> Recommend to Council that motion be passed author- <br /> izing the City Attorney to file its brief as of <br /> April 8 with the Court of Appeals in the Town of <br /> Superior vs. the City of Louisville case. Under- <br /> standing that settlement negotiations are continu- <br /> ing between the Town of Superior and the City of <br /> Louisville. <br />Fauson moved to have the city Attorney file its brief as of April 8, <br />1991 with the Court of Appeals in the Town of Superior vs. the City of <br />Louisville case, seconded by Hornbostel. All in favor. Motion passed. <br />PRESENTATION/DISCUSSION - LOUISVILLE PLAZA CENTER CONSTRUCTION <br />SCHEDULE <br />Peter Cudlip, Vice President, Louisville Plaza <br />Cudlip: Time to give update on the status of the Louis- <br /> ville Plaza, proposed K-Mart/King Sooper project <br /> we are working on. We are trying to push for a <br /> fall opening of K-Mart, as late as end of Febru <br /> ary, but due to the numerous items that are in <br /> volved in trying to develop a project of this <br /> magnitude, we just ran too late and also we ended <br /> up with some exciting news from King Soopers, so <br /> that we decided to delay the opening of K-Mart to <br /> March 92' compared to a fall, November 91' <br /> opening. King Soopers is going through its final <br /> analysis as to what the proper time t+2Xo open the <br /> store; original agreement to open in the fall of <br /> "93, now looks as if they will open in the summer <br /> between 1st quarter and 2nd quarter of .. 92. <br /> Developing the project in its entirety 'at one <br /> time, instead of two phases. We will be opening <br /> K-Mart in March and King Soopers either then or <br /> 3 <br />
