Planning Commission <br />Meeting Minutes <br />May 13, 2010 <br />Page 8 of 13 <br /> <br />Staff reviewed the project using the special review use criteria and found all five <br />(5) criteria have been met. <br />Staff recommends approval of the request, with the following conditions: <br /> Barriers shall be placed on the mid block curb cut on Pine Street to <br />1. <br />prevent access to the building. Staff shall work with the applicant to <br />determine the design of the barriers. <br /> The applicant shall place dust free surfacing on the western parking area, <br />2. <br />and stripe for 8 parking spaces. <br /> The outdoor patio shall not be used past 12 a.m. on any given day. <br />3. <br /> This SRU is granted to the applicant only and may not be assigned or <br />4. <br />exchanged at the time of any transfer or sale. <br />Commission Questions of Staff: <br />O’Connell asked for a clarification of a curb cut. <br />McCartney explained a curb cut is a driveway ramp onto a property. <br />Russell asked what would be historical of the site. <br />McCartney stated any building 50+ years old triggers a review by the Historic <br />Preservation Commission. <br />Sheets asked if a sidewalk is better than a curb cut. <br />McCartney explained there is a sidewalk running parallel to south side of the <br />building and the curb cut is perpendicular to the building and is used to allow <br />access to the inside of the garage area. He continued by stating the removal of <br />the curb cut would establish additional on-street parking. <br />Applicant Presentation: <br />Chad Sholders, Main Street Drink and Dine, 701 Main Street, stated the <br />following: <br />1) The entire dining experience depends on the patio space. <br />2) The owner of the building desires to keep the curb cut because the project <br />does not use the entire square footage of the building. The owner wants <br />the option to use the curb cut in the future. <br />3) The patio space will be re-designed and reflected on the site plan to <br />incorporate the 30’ x 30’ site triangle requirement. <br />4) The use of asphalt for the parking at the rear of the building will increase <br />the need for additional air conditioning of the building. He and the owner of <br />the building, in cooperation with the City, would like to find an alternative <br />dust free surface. <br />5) The closing time for the patio is planned for 2:00 A.M. <br />Commission Questions of Staff and Applicant: <br />McCartney discussed LMC 9.34.010.B.1 regarding the hours of operation as it <br />relates to the noise ordinance. He stated the Planning Commission has the <br />option to modify the hours of operation. <br />Sholders stated all mechanical devices will be turned off at midnight. <br /> <br />
