One of the concepts <br />proposed in the letter was that a portion of <br />the Harney site, particularly that area <br />located near the intersection of South Boul- <br />der Road and 42 would be zoned and developed <br />as a commercial site and that the balance of <br />the property is offered as dedication to <br />Boulder County for open space. <br /> <br />Staff is asking for Council direction in <br />this. <br /> <br />Sackett: The IGA is proposed prior to Lafayette basi- <br />cally annexing to our north. It is my under- <br />standing the IGA doesn't really exist; it is <br />a proposed IGA. Is there actually a legal <br />document that we could be held to? <br /> <br />Fauson: I don't know if a document was signed. This <br />would be a question we would ask our attorney <br />to research for us; if there is a document in <br />place; Tri-City Agreement. <br /> <br />Sackett: There's an opportunity for us to capture some <br />sales tax from the corner of South Boulder <br />Road and 42. I'm sure that could be included <br />in the plan. What I would like to know is <br />whether or not a valid agreement exists <br />between us and Lafayette before we go talk to <br />Lafayette. In my opinion they violated our <br />buffer understanding when they moved to the <br />north of us. My understanding is that there <br />is not a valid IGA and if there is not I <br />don't think we should talk to them. We should <br />decide ourselves what we want to do there. <br /> <br />Hornbostel: I think there is an IGA. My question is <br />going to be whether there is an IGA or not, <br />Susan also needs to look into a vote that was <br />taken by the whole City on this issue and <br />what kind of problems we could get into by <br />reversing a vote without taking another one. <br /> <br /> <br />Sackett: We can put it on a ballot and take it back to <br />the people. <br /> <br /> <br />11 <br />
