Would that be all right? <br /> <br />Fauson: Work Session would be good, Council could <br />discuss it. <br /> <br />OTHER REGULAR BUSINESS ITEMS ARISING AFTER PREPARATION OF AGENDA <br /> <br />NONE <br /> <br />CITY ATTORNEY'S REPORT <br /> <br />Griffiths passed out information on two pending cases involving <br />the City of Louisville. Griffiths commented on the case of <br />Lehman vs City of Louisville, proposed use of the church property <br />at 701 Grant street resulting initially in a law suit filed <br />against the City by the owner of the property. It was filed <br />originally in the Boulder District Court. The Boulder District <br />Court dismissed all of the claims against the City at the City'S <br />request; allowed the defendant to amend his complaint, which he <br />did adding some Federal claims. The case was then removed to the <br />Federal District Court for Colorado; Federal District Court <br />dismissed all Federal claims at the request of the City of Louis- <br />ville and at that time Councilmembers and various staff members <br />were added as defendants. There is one remaining state claim <br />left and it was sent back down to the Boulder District Court and <br />a decision was received this past week that dismissed the last <br />remaining claim against the City and all other defendants. The <br />third judge looking at this case agreed with the prior two judges <br />that the dismissal of the claims against the City and various <br />individuals was entirely correct. The only likelihood here is if <br />the plaintiffs chose to pursue this matter further, then the next <br />step likely would be an appeal in the Colorado Court of Appeals <br />or the Supreme Court. <br /> <br />Scott Ross will attend the August 6 Council meeting; both Susan <br />and Tami will be out of town on that date. <br /> <br />CITY ADMINISTRATOR'S REPORT <br /> <br />Brand: I met with people from Boulder County on <br />several different projects that we are work- <br />ing together on, one of which is the Coal <br />Creek Rock Creek Project. They said that <br />they have tried for sometime to get a Council <br />person to attend their meetings. They would <br />like to have a staff person and a Council- <br />member from each of the cities involved. I <br />suggested that they contact Councilwoman <br />Hornbostel because I knew she was very inter- <br />ested in trails in general. I think they <br /> <br /> <br />13 <br />
