Would the new build- ing be between his building be the same as the Blue Parrot who does not have a setback? Franklin: No, this building is attached immediately south of the existing Blue Parrot building. Between this proposed building and Mr. Varra's building is the parking lot which is owned by the Blue Parrot, so there would be an intervening open space between the new building and Mr. Varra's existing building. There still is a transitional area. Mayor Fauson stated that there was a motion and a second to approve the Final PUD Development Plan. Roll call was taken on the motion. Motion passed 7-0. Franklin: This was discussed at a Council Work Session and is based largely on state statutes and consultation with the City Attorney. Mayor Fauson moved to place Ordinance No. 1047, Series 1991 out for publication and set a public hearing for July 16, 1991, sec- onded by Howard. All in favor. ORDINANCE NO. 1048, SERIES 1991 - REVISED HOME OCCUPATION REGULA- TIONS - 1ST READING - SET PUBLIC HEARING Griffiths read by title only Ordinance No. 1048, Series 1991, "An Ordinance amending Section 17.16.040.H of the Louisville Munici- pal Code pertaining to Home Occupations." Franklin: This is a follow-up provision which is a companion to the Ordinance related to Massage Therapist. It is an option of Council to consider whether or not to allow Massage Therapy as a Home Occupation, now that they were deregulated by the State. This Ordi- nance will essentially include Massage Thera- pist as a prohibited use of Home Occupation as does health and beauty parlors and medical centers, etc. 9
