-_.,
formal role and be responsible for the tasks associated
with that.
Blankenship: Again, not having the benefit as you just stated of the
individuals III the conversations and whatever
documentation may have been involved, I researched
the case based on what I could find. Looking at it cold
and hard. This is an elected position and the other
position of the Administrative Assistant was first non-
exempt, then exempt and then non-exempt again. It
had made a flip-flop a couple of times.
Sackett: In your position, if we had no City Clerk and we asked
the Administrator's secretary to take the minutes and to
do the responsibilities of the City Clerk, how would we
consider that, exempt or non-exempt?
Blankenship: The position would be non-exempt.
Sackett: In that case we would need to pay overtime when it was
legally appropriate.
Blankenship: Yes.
Sackett: Herm, how do you remember that? Did she kind of
say, "I want to be City Clerk and want to be elected or
did ..."
Fauson: I don't recall what the conversation was in that respect
that she wanted or did not want that job. I think Terry
Hundley asked her to take it and do that work. I do
know, Bill, where many times where through the day
she would be working on City Clerk work then she
would stay over in the evening to complete her regular
job. What I am thinking is that the position was more
or less put on to her to do those things. Similar to what
we've done to some other people here.
Brand: To Linda.
Fauson: I thought we did that to Asti-Caranci.
Brand: She just has the title, Linda does the work.
18
