I just have to assume <br /> that they knew what they were doing. <br />Brand: Tom, they did approve the overtime, the thing we are <br /> looking at here is the difference in hour-to-hour and <br /> hour-to-one and a half hours. They approved the <br /> overtime and she was compensated on an hour to hour <br /> basis because she was assumed to be an exempt <br /> employee. When we discovered that all of those people <br /> should not have been exempt employees, but had to be <br /> non-exempt, under FLSA we went back and paid them <br /> the other half hour. They had been paid hour-to-hour <br /> for the comp time or the overtime. We had to go back <br /> and add on the additional half hour for everybody that <br /> cashed out before. She was here at that time doing the <br /> overtime approved on an hour-to-hour basis. <br />Davidson: I understand that, but I guess what I'm saying is the two <br /> past City Administrators evidently determined that the <br /> combination of her position made her exempt. Now <br /> whether they rightfully did it or wrongfully did it, I don't <br /> know. <br />Brand: They wrongfully did it because I know when I walked in <br /> and Linda was working overtime, I said be sure this <br /> goes on your time sheet and she said no, I am exempt <br /> and I said no your not. All the secretaries had been <br /> told they were exempt. They had all accepted it and as <br /> Bill said, they had been exempt and non-exempt and <br /> exempt and they really are non-exempt. <br /> 20 <br />
