<br /> ..., <br />Councilwoman Hornbostel excused herself from this Council agenda item due to conflict. <br />Griffiths commented that the changes that are proposed in the ordinance were <br />recommended by the Municipal Judge and were discussed by the Municipal Judge with the <br />Council at a previous work session. <br />Mayor Fauson moved to place Ordinance No. 1053, Series 1991 out for publication and <br />set public hearing for October 15, 1991, seconded by Carnival. All in favor. <br />Councilwoman Hornbostel returned to the meeting. <br />DISCUSSION/ACTION - NEUMANN ANNEXATION LETTER OF <br />INTEREST <br />On August 20, 1991, City Council directed staff to refer the Neumann Annexation Letter <br />of Interest to Boulder County and the Cities of Broomfield and Lafayette - parties to the <br />Northwest Parkway Agreement (IGA). <br />Boulder County and Lafayette, as parties to the IGA, do not support the proposed <br />annexation or land use. They would therefor not support an amendment to the IGA to <br />change the designation of this parcel from Open Space (for acquisition) to allow <br />development of the property. At this time, Broomfield has not submitted a formal <br />response. The IGA requires unanimous approval of amendments. <br />John Franklin, Director of Community Development, explained to Council that the <br />Northwest Parkway IGA does assign an open space for future acquisition designation to <br />this parcel. During the annexation process it is typical to deal with the question of zoning <br />and that part of the Neumannn's request is for commercial zoning. Commercial zoning can <br />be construed as a precursor to development and therefor raise the question of conflict or <br />amendment to the IGA. <br />Carnival: There is a road block in front of us if, and it is a big if, <br /> this Council should ask to precede. You would not be <br /> able to precede based on the two letters we received <br /> from Lafayette and the County indicating they did not; <br /> 1 ) approve of the annexation; and 2) would not accept <br /> the land use, correct? <br />Franklin: Not quite sir. The Northwest Parkway Agreement does <br /> not necessarily preclude annexation. It does however, <br /> call for amendments to the IGA as a precursor to <br /> development.
