This is in the IGA. <br />Griffiths: There is nothing in the Northwest Parkway Agreement <br /> that would limit Louisville's ability to annex the <br /> property. The IGA does affect the ability to alter the <br /> current uses or current permitted uses of the property. <br /> The Neumann's can continue to use the property even <br /> though it is designated as open space for its current <br /> purposes. I understand the agreement would permit. <br /> other purposes which are permitted by the current <br /> zoning. They could change the uses to those currently <br /> permitted. What the IGA does do is say if you change <br /> from the currently permitted or used purposes, then an <br /> amendment to the IGA would be necessary and that <br /> would have to be in agreement by all the parties. One <br /> of the questions here would be if the Neumann's would <br /> want to proceed with the annexation without the change <br /> in the zoning to a commercial use from the current <br /> uses. <br />Sackett: I would say highly unlikely given that the annexation <br /> agreement is going to assure that we can provide <br /> utilities there. <br />Neumann: The utilities is one of the major reasons for wanting to <br /> annex and if we were restricted to the use the way it is <br /> now, I would have to think about it and talk to my <br /> husband. If it would be possible, in the future, to <br /> change the use and annex now with the possibility of <br /> getting the utilities I would think that would be <br /> something that we would like to consider. <br />Fauson: This could be changed after 1995? <br />Franklin: There is always room for review. There is nothing so <br /> locked in that it couldn't be considered. The IGA <br /> suggests a 1995 reality check and the County eludes to <br /> that. Of course, our zoning and planning is in a <br /> constant process of flux depending upon development <br /> trends and needs. <br />Griffiths: The 1995 date is set out in the agreement and means <br /> that if the Northwest Parkway is not funded by 1995 by <br /> 6 <br /> ~- <br />
