Thal there are unique physical circumstances or conditions such as irregularity. <br />narrowness or shallowness of lot, or exceptional topographical or other physical <br />conditions peculiar to the affected property: <br />The current lot at 105 Roosevelt (100' wide X 150' deep = 15,000 sq, ft.) is too large and wide to fit <br />the intent of the Old Town District. This existing large lot is a use by right lot for o large home <br />development of 5,250 square feet plus basement and could be permitted today to be built. This <br />large 100' width and developable lot is not consistent with the existing neighborhood character <br />and the Old Town District. <br />This variance request would allow the existing modest residence to remain, the three large <br />existing front yard street trees to be preserved, and allow for a proposed modest residence to <br />be built. These items would be consistent with the existing neighborhood character and Old <br />Town. <br />2. That the unusual circumstances or conditions do not exist throughout the <br />neighborhood or district in which the property is located: <br />This large 15,000 square foot lot, use by right large possible developed home and 100' lot width <br />dimension is an unusual circumstance and does not exist throughout the neighborhood or Old <br />Town. Within 700 foot radius of this property 68% of lot sizes are 8,500 square feet or smaller and <br />property widths range from 37' to 80'. <br />This variance request lot split provides for two lots with 40' and 60' widths and 6,000 and 9,000 <br />square foot lot sizes. These proposed lots would be more consistent with the existing <br />neighborhood character and Old Town. <br />3. Thor because of such physical circumstances or conditions, the property cannot <br />reasonably be developed in conformity with the provisions of this title (Louisville <br />zoning code): <br />This neighborhood and Old Town have 563 residential properties in which only 8 hove 4,000 sf or <br />more of living area. The current large 15,000 square foot lot, wide 100' lot frontage and use by <br />right large possible developed residence of 5.250 square feet is out of scale and not consistent <br />with the existing neighborhood and Old Town character. Thus the property could not be <br />developed reasonably in conformity with the Louisville Zoning Code, Louisville Comprehensive <br />Plan and would not be consistent with the existing neighborhood and Old Town character. <br />This variance request supports the Louisville Comprehensive Plan and Old Town District Design <br />Character. The proposed two smaller lots, keeping the existing modest residence and the <br />proposed modest residence would be a more reasonable use of the property consistent with <br />the existing neighborhood, Old Town District and Louisville's unique character. <br />
