Staff recommends approval of the request, with the following conditions: 1. Barriers shall be placed on the mid block curb cut on Pine Street to prevent access to the building. Staff shall work with the applicant to determine the design of the barriers. 2. The applicant shall place dust free surfacing on the western parking area, and stripe for 8 parking spaces. 3. The outdoor patio shall not be used past 12 a.m. on any given day. 4. This SRU is granted to the applicant only and may be assigned or exchanged at the time of any transfer or sale. Commission Questions of Staff and Applicant: McCartney discussed LMC 9.34.010.B.1 regarding the hours of operation as it relates to the noise ordinance. He stated the Planning Commission has the option to modify the hours of operation. Sholders stated all mechanical devices will be turned off at midnight.
