RESOLUTION NO. 20 <br />SERIES 2003 <br /> <br />A RESOLUTION APPROVING THE BOULDER COUNTY COUNTYWIDE <br />COORDINATED COMPREHENSIVE DEVELOPMENT PLAN <br />INTERGOVERNMENTAL AGREEMENT <br /> <br /> WHEREAS, an intergovernmental agreement, entitled the Boulder County Countywide <br />Coordinated Comprehensive Development Plan Intergovernmental Agreement (the "Plan"), has <br />been proposed among the City of Boulder, the City of Lafayette, the City of Longmont, the City <br />of Louisville, the Town of Erie, the Town of Jamestown, the Town of Lyons, the Town of <br />Nederland, the Town of Superior and the County of Boulder; and <br /> <br /> WHEREAS, the City is authorized to execute the proposed Plan pursuant to C.R.S. §29- <br />20-105, which authorizes the parties to cooperate and contract with each other for the purpose of <br />planning and regulating the development of land by means of such a comprehensive development <br />plan; and <br /> <br /> WHEREAS, the City is further authorized to execute the proposed Plan pursuant to the <br />City home rule charter and state law, including but not limited to section 6 of article XX and <br />section 18 of article XIV of the Colorado Constitution; part 2 of article 1 of title 29; part 1 of <br />article 20 of title 29; part 1 of article 12 of title 31; and parts 2 and 3 of article 23 of title 31, <br />C.R.S.; and <br /> <br /> WHEREAS, the purposes of the proposed Plan include supplementing various <br />underlying comprehensive development plan intergovernmental agreements previously entered <br />into by two or more of the parties to the proposed Plan; providing agreement by the municipal <br />parties to the Plan to comply in certain respects with the underlying plans to which a municipal <br />party was not a party; permitting in certain instances new extraterritorial water service; covering <br />by a comprehensive development plan additional unincorporated areas not covered by any <br />underlying plan, and providing for related terms and provisions within such a countywide, <br />coordinated comprehensive development plan; and <br /> <br /> WHEREAS, the proposed Plan is intended to and will assist in preserving the unique and <br />individual character of the City of Louisville; and <br /> <br /> WHEREAS, the proposed Plan is intended to preclude increased development and urban <br />sprawl which would obliterate the boundaries of the municipal parties to the proposed Plan, and <br />would, if permitted in unincorporated areas, require the provision of urban services within such <br />unincorporated areas; and <br /> <br /> WHEREAS, the designation of certain lands within the area subject to the proposed Plan <br />as Rural Preservation for the purpose of preserving a community buffer serves the economic and <br />civic interests of the citizens of Louisville and meets the goals and furthers the purposes of the <br />City's Comprehensive Plan; and <br /> <br /> WHEREAS, the proposed Plan, including specifically the annexation and utility service <br />portions thereof, is intended to encourage the natural and well-ordered future development of <br />each party; to promote planned and orderly growth in the affected areas; to distribute fairly and <br /> <br /> <br />
