AMENDED LEASE AGREEMENT
<br /> THIS LEASE AGREEMENT (hereinafter "Lease is made and entered effective as of the
<br /> 1st day of June, 2010, by and between the City of Louisville, a Colorado municipal corporation
<br /> (hereinafter "Lessor and the Roland Radcliff, whose address is P.O. Box 264, Louisville, Colorado
<br /> 80027 (hereinafter "Radcliff'), and Karim Amirfathi, 7150 South Boulder Road, Boulder, CO
<br /> 80303 (hereinafter "Amirfathi Radcliff and Amirfathi are collectively referred to as "Lessee
<br /> WHEREAS, Lessor is the owner of certain real property described as Lot 6, Block 4, Town
<br /> of Louisville, County of Boulder, State of Colorado, which lot has an address of 611 Front Street,
<br /> Louisville, Colorado and upon which property is located a one -story frame upholstery shop; and
<br /> WHEREAS, Radcliff entered into a month -to -month lease with Lessor in November 2008,
<br /> and Lessor, Radcliff and Amirfathi desire to enter into an amended lease of such property to include
<br /> Amirfathi as an additional leasing party; and
<br /> WHEREAS, Lessor is authorized to enter into this Lease pursuant to its home rule charter
<br /> and other applicable law;
<br /> NOW, THEREFORE, the Lessor and Lessee agree as follows:
<br /> 1. Leased and Reserved Premises. In consideration of the payment of rent and
<br /> performance of the covenants and agreements set forth in this Lease, the Lessor leases to Lessee that
<br /> certain real property described as Lot 6, Block 4, Town of Louisville, County of Boulder, State of
<br /> Colorado and having a street address of 611 Front Street, Louisville, Colorado, 80027, together with
<br /> improvements and any furniture or equipment of Lessor located thereon (hereinafter the "Leased
<br /> Premises
<br /> 2. Term. The term of this Lease shall be month -to -month commencing on the 1st day of
<br /> June, 2010 and continuing until terminated by either Lessor or Lessee upon 30 days' prior written
<br /> notice or as provided in this Lease.
<br /> 3. Purposes. The Leased Premises may be occupied and used by Lessee pursuant to this
<br /> Lease solely for the following purposes: an upholstery shop, retail grocery and associated garden.
<br /> 4. Rent and Utilities. As consideration for this Lease, Lessee shall pay the Lessor rent in
<br /> the amount of $350.00 per month, payable in advance on the 1st day of each month. Such amount
<br /> shall be a flat rent for each month, and shall not be prorated based on the number of days in each
<br /> rental period. Rent shall be payable to the City of Louisville, 749 Main Street, Louisville, Colorado,
<br /> 80027, or to such other address as directed by Lessor. Rent not paid by the 10th day of the month
<br /> shall be subject to a late fee of $20.00. In addition to rent, Lessee shall be solely responsible for
<br /> payment of, and shall directly pay to the providers when due, all utility charges for water, sewer, gas,
<br /> electric, cable, telephone, trash and other services for the Leased Premises.
