That there are unique physical circumstances or conditions such as irregularity, <br />narrowness or shallowness of lot, or exceptional topographical or other physical <br />conditions peculiar to the affected property. <br />Staff finds the property has unusual physical circumstances created from the retaining wall <br />and the rear neighboring lot that is perpendicular to the property. The rear property line abuts <br />the side yard of a neighboring lot at 360 Troon Ct. The neighboring lot is 2-8 ft. above the <br />grade of 953 St Andrews in portions that abut the rear lot line, and development of 360 Troon <br />Ct would likely impact shade on 953 St Andrews more than a typical rear -yard facing <br />neighbor. The wall is necessary to create stable grading and drainage for the properties <br />along Troon Court and St Andrews Lane. The wall creates a monolithic structure on the <br />eastern and southern boundaries that shades the property. That the unusual circumstances or conditions do not exist throughout the <br />neighborhood or district in which the property is located. <br />This property is the only lot in the Coal Creek Filing 3 neighborhood that is at the bottom of <br />a retaining wall of this magnitude that abuts both a rear and side property boundary. Staff <br />finds the proposal meets this criterion. <br />3.
