<br />ORDINANCE NO. 857 <br /> <br />AN ORDINANCE AMENDING CHAPTER 8.08 <br />OF THE LOUISVILLE MUNICIPAL CODE <br />CONCERNING RESPONSIBILITY FOR <br />CUTTING OF WEEDS WITHIN THE CITY OF <br />LOUISVILLE. <br /> <br />WHEREAS, the City Staff has recommended certain chanages <br />to clarify Sections of the Louisville Municipal Code regarding <br />cutting of weeds; and, <br /> <br />WHEREAS, the City Council of the City of Louisville <br />believes the adoption of the following ordinance would alleviate said <br />problems. <br /> <br />NOW THEREFORE BE IT ORDAINED BY THE CITY COUNCIL OF THE <br />CITY OF LOUISVILLE, COLORADO: <br /> <br />Section 1. Section 8.08.010, 8.08.020 and 8.08.030 of <br />of the Louisville Municipal Code are hereby repealed. <br /> <br />Section 2. The following Sections are hereby added to <br />Chapter 8.08, and Title 8 of the Louisville Municipal Code: <br /> <br />8.08.010 Definitions. For the purposes of this Chapter, <br />the following-definitions shall apply: <br /> <br />a) "Weeds" includes, but is not limited to: Canada <br />thistle, common ragweed, fireweed, milkweed, perennial <br />sowthistle, Russian knapweed, Russian thistle, sandburs, woollyleaf, <br />povertyweed, curly dock, Johnsongrass, leafy spurage, dalmation <br />toadflax, yellow toadflax and any other type of noxious weeds <br />specified by the U.S. Department of Agriculture; but not to include <br />flower gardens, vegetable gardens, plots of shrubbery, grain plots, <br />pastures used for feed, pastures used for wildlife, fodder, forage or <br />crops grown for consumption or commercial purposes. <br /> <br />b) "Owner, Agent or Occupant" shall be construed to <br />include tenants as well as landowners and shall include and be <br />applicable to the City of Louisville, Colorado and all subdivisions <br />and agencies thereof. <br /> <br />c) "Property" shall mean any real property lcoated within <br />the city limits of the City of Louisville, Colorado. <br /> <br />d) "Director" means the Director of Community Services of <br />the City of Louisville, his successor in office, or designee. <br /> <br />8.08.020 Cutting Required. Weeds shall be kept cut to a <br />height no~ in-excess of siX-inches. It shall be the duty of the <br />owner, agent, or occupant of any property to cut the weeds on said <br />
