<br /> E. "Floor area" means the area included within the <br />surrounding exterior walls of a building or portion thereof, measured <br />form the inside of all exterior walls which is finished for living <br />purposes and does not include garages and unfinished subgrade levels. <br /> F . "Capital Improvement Fee" means the fee <br />determined by this Chapter, and any subsequent thereto, to be used <br />for the creation of the capital improvement fund. <br /> G. "Capital Improvement Fund" means a special fund, <br />for accounting purposes created by this Chapter for the purpose of <br />constructing and maintaining capital improvements within the City of <br />Louisville including the acquisition of real estate on which said <br />improvements may be constructed. <br /> H. "Public structures" means any structure which <br />shall be used by the general population and which is owned by a <br />governmental entity. <br /> I. "Treasurer" means the duly appointed treasurer of <br />the city. <br /> 3.16.020 Fee Designated. Any contractor applying for a <br />building permit for a residential dwelling unit in accordance wi th <br />Chapter 15.04 shall, as a condition of obtaining such building <br />permit, pay to the City a capital improvement fee, as follows: said <br />fee shall be paid to the Building Official in the amount of $1,650 <br />per unit, wi th an additional fee of $2.25 per square foot floor area <br />as defined in Section 3.16.010, as the same may be determined from <br />the plans and specifications submitted to the Building Official as <br />part of the application for a building permit. <br /> 3.16.030 Capital Improvemen t Fund-Created. There is <br />hereby created a capital improvement fund in the City. All capital <br />improvement fees collected in accordance wi th Section 3.16.020 shall <br />be paid into a special and segregated fund. The Treasurer shall <br />account separately for all receipts and disbursments to and from the <br />fund and shall not co-mingle any part of said fund wi th other funds <br />of the City. <br /> 3.16.040 Applicability. Capital Improvemen t fee shall <br />apply to only new construction and shall not apply to alterations or <br />additions to an existing structure. The fee shall not apply to the <br />construction of an accessory structure or to remodeling, improvements <br />or additions to a structure subsequent to the issuance of the <br />original certificate of occupancy for said structure. In addition, <br />no fee shall be charged under this Chapter when the new residential <br />unit to be constructed replaces an existing residential unit on the <br />site. <br /> -2- <br />
