<br /> 4. The person attacked or bitten was engaging in unlaw- <br />ful entry into or unlawfully in or upon a vehicle in which the <br />animal was confined. <br /> 5. The person attacked or bitten was attempting to aid <br />the animal when it was injured. <br /> 6 . The person attacked or bitten was attempting to cap- <br />ture the animal In the absence of the owner or keeper. <br /> For the purposes of this section, a person is lawfully <br />upon the premises of an owner or keeper when such person lS on <br />said premises in the performance of any duty imposed by law, <br />including the laws or postal regulations of the United States, <br />or by the express or implied invitation of the owner of such <br />premises or the owner's agent. <br /> D. If an animal lS found to be vicious under subsection <br />B of this section, then the municipal court judge shall have the <br />authority to order that the owner of the animal lose all rights <br />of ownership and control of the anima 1 . If the animal has bitten <br />or injured a person more than once, he may order that the animal <br />be destroyed. <br /> If an animal has bitten or injured a person, the judge <br />may require the owner to sign an agreement which contains, but lS <br />not limited to the following conditions, before the animal is <br />released to his custody: <br /> 1. To keep the animal confined on his premises in an <br />enclosure approved by the code enforcement officer. <br /> 2. To keep the animal securely muzzled, leashed and <br />under the control of a person eighteen ( 18) years of age or <br />older, and who is physically capable of restraining the animal <br />when the animal is off his property. <br /> 3 . A violation of this agreement will result in the <br />animal being impounded and destroyed. <br /> 4. To prove financial responsibility by posting a bond <br />or certificate of insurance for the amount of $10,000.00, or <br />more. <br /> 5 . To inform, along with animal control, any City, <br />County, Postmaster, utility company meter readers, and anyone <br />else that comes on the property vIi th implied consent or peaceably <br />and lawfully of the animal's viciousness if the animal lS moved <br />into an area. <br /> E.
