He suggested another meeting to <br />discuss the following: <br />. Language regarding the 'not a use by right' <br />. How to deal with the 50% limit of 3rd floor and is there another way to <br />accomplish the tapering of that floor. <br />. Limiting the total square footage for downtown. <br /> <br />Loo stated that she agrees with Lipton's suggestions. She also suggested that the <br />transition area should be addressed at a later date and not during this review of building <br />height. <br /> <br />Sheets had no additional comments. <br /> <br />Motion to Continue: Deborski moved and Dalton seconded a motion to continue the <br />discussion to the February 9, 2006 meeting. Posted in City Hall, the Louisville <br />Public Library, the Recreation Center and the Courts and Police Department Building and <br />mailed to the surrounding property owners on December 23,2005. The agenda was <br />posted on the City's web site and at City Hall, the Louisville Public Library, the <br />Recreation Center and the Courts and Police Department Building on January 5,2006. <br /> <br />Conflict ofInterest and Disclosure: Lipton recused himself as Mr. Hillam, one of the <br />applicants, is a personal friend. No other disclosures or conflict of interests from the other <br />Commissioners. <br /> <br />Staff Report of Facts and Issues: <br />Wood provided the following summary: <br />. Subject property located at 201 West Spruce, approximately 1.05 acres. <br />. Annexed in 2004 as Parcel C of the Pickett Annexation and was zoned single- <br />family low-density (SF-LD). <br />. Request is to subdivide the parcel into two residential lots with a relief through <br />the PUD as follows: <br />1. A lot frontage of 90 linear feet for Lots 1 & 2, rather than the required 120 <br />linear feet. <br />2. A side yard setback of 15' rather than the required 20'. <br />3. A minimum combines side yard setback from an interior lot line of30' <br />rather than the required 40' . <br />. Staff recommends support of the reduced lot frontage and side yard setbacks. <br />
