SIMMONS <br />CITY MANAGER <br />DATE: February 10, 2004 <br />SUBJECT: Discussion /Direction — Amendment to the Superior IGA <br />ORIGINATING DEPARTMENT: City Manager's Office <br />SUMMARY: <br />The Town of Superior is requesting an amendment to the 1997 Superior - Louisville <br />Intergovernmental Agreement to allow for multi - family residential uses as part of a 'town center' <br />mixed use development on the Biella- Menkick property. Under the present terms of the IGA, no <br />residential is allowed on this property. This matter was last discussed at the January 20, 2004 <br />City Council meeting. At that meeting the Council suggested that the City Attorney and the <br />Superior Town Attorney review and write a proposed amendment. This item is scheduled and <br />advertised for the February 17, 2004 regular meeting. <br />Subsequent to the meeting, Superior proposed language in response to Council comments. <br />Upon review, Louisville City staff thought perhaps quantifying the minimum retail requirement <br />for the parcel while still allowing for multi - family uses on the property might be a better <br />approach as contrasted to language such as 'anchoring retail (or commercial) uses', or <br />`Superior shall not permit development of other than retail uses on 34 acres of the south <br />property'. <br />Discussion ensued between the respective managers of Louisville and Superior. The typical <br />density for retail uses in Superior's Comprehensive Plan is .25 FAR. A varying range of <br />minimum retail (sales tax generating) square footage was discussed. Based on 34 acres, a .20 <br />FAR (or floor area ratio) would require a minimum 298,000 square feet of retail to be <br />constructed. <br />Superior has stated that they would consider a 150,000 square foot retail requirement. This is <br />approximately .10 FAR. <br />Staff suggests that quantifying the minimum retail in the Agreement is the preferred way to <br />structure the\amendment while accomplishing Superior's goals also.
