He stressed if a contract is not approved by late October or early <br /> November, the City will not receive the full benefit of the locked -in rate, which expires <br /> March of 2011. <br /> Councilor Dalton preferred to discuss this matter at a Study Session and then conduct <br /> at least two public hearings. <br /> Councilors agreed Staff should continue negotiations while Council further discusses <br /> this matter at the September 14, 2010 Study Session. Staff could then make a <br /> presentation on the first or second City Council meeting in October. <br /> MOTION: Councilor Muckle moved the City Council approve Staffs recommendation; <br /> further discuss this matter at a Study Session on September 14, 2010 and conduct <br /> public hearings, seconded by Mayor Pro Tem Marsella. <br /> City Attorney Light asked Public Works Director Phare if Staff's recommendation was to <br /> authorize final negotiations for a PIPA, or for an alternative lease approach. Public <br /> Works Director Phare stated they would like to keep all their options open. <br /> Councilor Yarnell offered a friendly amendment to the motion to change the word in the <br /> recommendation from "enter" to "continue" negotiations. Councilor Muckle and Mayor <br /> Pro Tem Marsella accepted the friendly amendment. <br /> VOTE: All were in favor. <br /> RESOLUTION No. 52, SERIES 2010 A RESOLUTION APPROVING A SPECIAL <br /> REVIEW USE (SRU) TO ALLOW FOR PLACEMENT OF SOLAR PHOTOVOLTAIC <br /> ARRAY ON THE CITY OF LOUISVILLE'S SOUTH WATER TREATMENT PLANT <br /> LOCATED AT 7000 MARSHALL ROAD <br /> Principal Planner McCartney explained Resolution No. 52, Series 2010 is an application <br /> for a special review use (SRU) to authorize a private utility to place a solar array on the <br /> South Water Treatment Plant located at 7000 Marshall Road. This site is surrounded <br /> by Boulder County and zoned Agricultural. The Louisville Municipal Code Guidelines <br /> were applied to this property. He explained the solar photovoltaic panels would be <br /> placed at the back of the property. The height limitation is twelve feet. <br /> PUBLIC COMMENTS <br /> Mark Persichetti, 1402 Taft Place, Louisville, CO stated he is a member of the Louisville <br /> Sustainability Advisory Board, but would speak solely for himself. He supported the <br /> solar photovoltaic panels and encouraged Ward I Councilors to support all three <br /> Resolutions. He supported reducing the dependence on non renewal energy sources <br /> by using renewable energy sources for residents and businesses as well as City <br /> facilities. <br />
