IX. Current Events <br />City Council Water Committee <br />Meeting Minutes <br />Friday, July 16, 2010 <br />Page 2 of 3 <br />their meters upgraded. City staff will continue to pursue these project holdouts <br />and may need Council direction as to the proper form of motivation for <br />compliance; assessing special fees or service shut off. Of the meters installed <br />less than 1% have had any issues, usually being overly noisy. It was <br />suggested that staff track any meter issues and contact the manufacture <br />shortly before the first anniversary of the meter's installation. <br />b. NWTP Filter Media Replacement — staff is working with the contractor to <br />resolve an issue related to non - compliant media. <br />c. NWTP Filter Control Consoles — The project was successfully completed. <br />d. Water Facilities Plan — Public Works will be presenting Council with a CIP <br />request for a Water Facilities Plan. The plan will evaluate the City's current <br />and future demands and associated infrastructure. It will assist in determining <br />the project priorities, scheduling and funding requirements. A discussion <br />followed on the utilization of the plan as a guide for capital projects, O &M, <br />levels of service, emergencies, financing, etc. The Committee favored the Plan <br />and placed an emphasis on insuring the financial wherewithal of the Utilities. It <br />was then suggested that the next meeting address the financing of the utilities <br />in regards to lower demands, conservation efforts, rate structures, etc. to insure <br />that costs can be covered. <br />e. Water Conservation — Still working with the State to craft a Water Conservation <br />Plan to both our liking. Since the late 1990's the City has seen a steady <br />decline in per capita daily demands, but it has yet to be determined how much <br />of this is truly conservation or weather and economics related. The City is <br />doing a lot of good things and it was suggested that the City should get more of <br />that information out to the public (i.e. highlight rebates on the website). <br />f. Other — The Windy Gap Firming Project continues with permits Bureau of <br />Reclamation's schedule predicted the release of the Final EIS in September <br />with the remainder of permits to follow by early spring. Negotiations continue <br />with West Slope entities. <br />VIII. Legal <br />a. Marshall Lake /South Boulder & Coal Creek Ditch Transfer Case — a draft Ruling <br />has been sent to opposers with discussions to follow. The case is on the <br />Referee's docket, If a trial is necessary it would likely be mid 2012 at the <br />earliest. <br />b. Diligence cases — Mr. Hill has been contacting the opposing parties on a <br />regular basis. They haven't had the opportunity to review the cases yet. <br />c. Other — nothing else to report <br />a. Status of Denver Water's Moffat System Expansion — Denver continues to have <br />discussions with the West Slope and is still working on their draft EIS. While <br />Lafayette and City of Boulder were able to acquire storage space in Gross <br />(assuming the project is built) to be utilized for instream - flows, Louisville's <br />intake locations prevent it from being part of any mitigation.
