City staff will continue to pursue these project holdouts and may need Council direction as to the proper form of motivation for compliance; assessing special fees or service shut off. Of the meters installed less than 1% have had any issues, usually being overly noisy. It was suggested that staff track any meter issues and contact the manufacture shortly before the first anniversary of the meter's installation. b. NWTP Filter Media Replacement — staff is working with the contractor to resolve an issue related to non - compliant media. c. NWTP Filter Control Consoles — The project was successfully completed. d. Water Facilities Plan — Public Works will be presenting Council with a CIP request for a Water Facilities Plan. The plan will evaluate the City's current and future demands and associated infrastructure. It will assist in determining the project priorities, scheduling and funding requirements. A discussion followed on the utilization of the plan as a guide for capital projects, O &M, levels of service, emergencies, financing, etc. The Committee favored the Plan and placed an emphasis on insuring the financial wherewithal of the Utilities. It was then suggested that the next meeting address the financing of the utilities in regards to lower demands, conservation efforts, rate structures, etc. to insure that costs can be covered. e. Water Conservation — Still working with the State to craft a Water Conservation Plan to both our liking. Since the late 1990's the City has seen a steady decline in per capita daily demands, but it has yet to be determined how much of this is truly conservation or weather and economics related. The City is doing a lot of good things and it was suggested that the City should get more of that information out to the public (i.e. highlight rebates on the website). f. Other — The Windy Gap Firming Project continues with permits Bureau of Reclamation's schedule predicted the release of the Final EIS in September with the remainder of permits to follow by early spring. Negotiations continue with West Slope entities. VIII. Legal a. Marshall Lake /South Boulder & Coal Creek Ditch Transfer Case — a draft Ruling has been sent to opposers with discussions to follow. The case is on the Referee's docket, If a trial is necessary it would likely be mid 2012 at the earliest. b. Diligence cases — Mr. Hill has been contacting the opposing parties on a regular basis. They haven't had the opportunity to review the cases yet. c. Other — nothing else to report a. Status of Denver Water's Moffat System Expansion — Denver continues to have discussions with the West Slope and is still working on their draft EIS. While Lafayette and City of Boulder were able to acquire storage space in Gross (assuming the project is built) to be utilized for instream - flows, Louisville's intake locations prevent it from being part of any mitigation.
