<br />Board of Adjustment <br />Meeting Minutes <br />February 15, 2006 <br />Page 3 of 5 <br /> <br />3. Property cannot reasonably be developed. Staff has struggled with this criterion <br />in previous similar variance request primarily because staff felt that one large <br />home was still "reasonable development of the property." In further consideration <br />of this condition based in part on past Board decisions, we have determined that <br />this criterion has been met with this proposal. We base that determination in part <br />on one definition of "reasonable", which is "not excessive or extreme; moderate". <br />The proposed lots would support more moderately sized homes than one single <br />lot. <br />4. Not created by applicant. The lot configuration was created in 1904 at the time of <br />the original platting of the subdivision - long before this applicant had any <br />affiliation with the property. This criterion has been met. <br />5. Neighborhood Character and use of adiacent property. The lots will be controlled <br />by the Old Town Overlay. Additionally, the applicant has provided character <br />elevations to represent the type of project they wish to build, which we believe to <br />be in keeping with the Old Town character. This criterion has been met. <br />6. Minimum variance to afford relief. Two (2) lots are one (1) more than allowed, <br />so the minimum request. Lot widths are roughly equal. This criterion has been <br />met. <br />. Staff is recommending approval, without condition. <br /> <br />Board Questions of Stat!: <br />Weise inquired if the proposed homes were 2-story or lI1z - story. <br /> <br />Johnstone reminded the Board that these are not the absolute design for the homes to be built. <br /> <br />Loeblich asked about the height limitations in the Old Town Overlay. <br /> <br />Johnstone stated there is a 27 foot maximum and the Old Town Overlay will also control all <br />setbacks. <br /> <br />Weise discussed with staff, for clarification, how lot coverage and floor area ratios are <br />calculated. He expressed concern with the total square footage that could be built feeling that it <br />might appear overpowering for the size of the requested lot sizes. <br /> <br />Applicant Presentation: <br />Michael Nunez and Tom Ramsey, partners in WestMark Design & Construction, reviewed their <br />professional background for the Board. They also provided details of the lot size analysis that <br />was conducted by a survey company they had hired. <br /> <br />Ramsey discussed the type of homes they build: period style homes, tailored to the site, and no 2 <br />homes the same. <br /> <br />Board Questions of Applicant: <br />Kelly requested they review of six criteria for the variance request. <br /> <br />Nunez provided a brief review of the criteria also stated they had met all six criteria. <br /> <br />Loeblich requested more details of the lot analysis. <br /> <br />Nunez explained that the survey company used the assessor's database for their data collection. <br /> <br />Public Present in Favor of Application: None heard. <br />
