COUNCIL COMMUNICATION <br />TO: MAYOR AND CITY COUNCIL <br />FROM: MALCOLM FLEMING, CITY MANAGER <br />DATE: OCTOBER 5, 2010 <br />SUBJECT: APPROVAL OF REVOCABLE LICENSE AGREEMENT WITH CITIZENS <br />COMMUNITY TV TO LOCATE HEADEND IN CITY HALL <br />ORIGINATING DEPARTMENT: CITY MANAGER’S OFFICE <br />SUMMARY: <br />The City approved an agreement in 2006 with Citizens Community TV (CCTV54) to run the <br />public access channel (Channel 54) which the City receives from its franchise agreement with <br />Comcast. Since 2006, CCTV54 has located their studio in office space in Louisville with a <br />Comcast headend on site to provide the connection from the CCTV54 studio to the Comcast <br />distribution system. <br />At this time CCTV54 would like to relocate that headend to City Hall. Because City Hall is the <br />location of the headend for Channel 8, the addition of a second headend at this facility is a <br />relatively simple process for Comcast and rather inexpensive. While the headend and some <br />network equipment would be located at City Hall, studio space would remain in a separate <br />location and the headend would be activated remotely. <br />CCTV54 makes this request so that they may have the ability to locate their studio at the most <br />cost effective space. To move the headend to a new studio is cost prohibitive, but by moving it <br />to City Hall and accessing it remotely they can locate their studio wherever they find the best <br />priced space. <br />The attached revocable license agreement sets out the framework of moving the headend to <br />City Hall. The agreement includes the following provisions: <br /> CCTV54 may have reasonable access to the facility <br /> Access during normal business hours <br />o <br /> A staff contact will be identified and can offer after hours access IF available <br />o <br /> Liability issues are addressed: <br /> If the City damages CCTV54 equipment <br />o <br /> If CCTV54 damages City equipment <br />o <br /> If CCTV54 damages the building during installation <br />o <br /> CCTV54 must pay for the installation of all equipment <br /> CCTV54 must pay for the installation and monthly payments for separate broadband <br />access <br />SUBJECT AGENDA ITEM <br />APPROVAL OF REVOCABLE LICENSE <br />AGREEMENT WITH CITIZENS COMMUNITY <br />4E <br />TV TO LOCATE HEADEND IN CITY HALL <br />45 <br /> <br />
