Part of the renovation includes an addition of a partial second floor. <br />All proposed additions fall within all existing set backs that are present on the site today. <br />The property is a corner lot of 50' x 125'. The existing house is nonconforming only with <br />respect to the required side street setback of 25'. <br />The following is a description of responses to the 6 criteria items required: <br />1. That there are unique physical circumstances or conditions such as <br />irregularity, narrowness or shallowness of lot, or exceptional topographical <br />or other physical conditions peculiar to the affected property, <br />There is an existing house on the property which is nonconforming. Also this is a corner <br />lot of 50' x 125'. <br />2. That the unusual circumstances or conditions do not exist throughout the <br />neighborhood or district in which the property is located, <br />Not applicable ( The zoning is unusual as a majority of properties in the area are <br />nonconforming.) That because of such physical circumstances or conditions, the property <br />cannot reasonably be developed in conformity with the provisions of Title 17 <br />of the Louisville Municipal Code, <br />The existing house is already located on the property. Development in areas other than <br />where the house is presently located would be unreasonable and would probably result in <br />non conforming lot coverage. <br />4. That such unnecessary hardship has not been created by the Applicant, <br />House and property were present long before any zoning ordinance was adopted. <br />
