Staff Presentation of Facts and Issues: <br />Ken Johnstone gave the staff summary, stating the terms of the 6 criteria and how the applicant <br />had not met all criteria. Johnstone recommended that this variance not be approved. <br />Board Questions of Staff: <br />Member Campbell: <br />Q. In regards to number 3, where you said other houses in the subdivision had this type of a <br />sun room, would you happen to know one address? I didn't see any. <br />A. Johnstone: There are sun rooms in the area, in fact there's one across the street that was <br />part of the original construction across Eisenhower Drive to the west. It's smaller in size <br />and within the setback requirements. <br />Member Dinsmore: <br />Q. <br />What are the dimensions on the patio again? <br />A. Johnstone: 10 or 12 feet in depth depending on whether you're measuring from the back <br />of the chimney or from the back of the main house. So it's approximately 12 x 20. <br />Applicant Summary: <br />Lisa Helm, from Patio Enclosures Incorporated represented Frank and Virginia Armour in their <br />request for relief from the 25-foot rear setback requirement. She did not have any questions for <br />the City, but wanted to add that due to the lot size and the existing concrete patio that's there, <br />they would like to be granted relief from the setback requirement on that side. She did not <br />disagree with anything that had been brought up as far as meeting the hardships. She did, <br />however, want to state that there have been no objections by the homeowners association or the <br />adjacent neighbors to do this enclosure, and therefore the homeowners are still adamant about <br />asking for this request for a variance. <br />Questions From the Board: <br />Chairman Shiker: <br />Q. <br />Can you explain to me, since one of the criteria is to try to and do the least amount of <br />variance required, the considerations given to a 10-foot depth versus a 12-foot depth? <br />A. Lisa Helm: That would leave approximately 2 feet of concrete extended beyond the room <br />which is not even a legal landing. Aesthetically it would not be very acceptable. A 10 <br />2 <br />
