555 Orchard Drive <br />Louisville, CO 80027 <br />29 November, 1994 <br />City of Louisville <br />Board of Adjustment <br />749 Main Street <br />Louisville, CO 80027 <br />To the Board: <br />A request for a zoning variance of approximately 3'6" on the <br />front setback of the property. <br />The improvements were laid out on the site by the <br />architect/contractor relying on the nail/copper washer lot <br />locators imbedded in the sidewalk at the front of the site. No <br />offset was indicated on the washers and the measured distance to <br />the rear of the electric utility pad was exactly 115'. This <br />matched the lot dimensions as shown on the developers subdivision <br />plat. <br />Shortly after the site was surveyed, a question arose as to the <br />proper location of the improvement from the front setback. The <br />city inspector called the contractor who in turn contacted the <br />surveyor. After some back and forth discussion between the <br />parties, the original survey was held to be incorrect and a <br />corrected survey document was filed. This was the source of the <br />original error which was not flagged by any of the responsible <br />parties. <br />No additional mention of a possible setback error was made until <br />the request for the final inspection so a certificate of <br />occupancy could be issued. It was then determined by the city <br />that the improvements encroached on the front setback by <br />approximately 3'6". <br />There appear to be three alternative solutions to the problem: <br />1. Granting of a variance by the Board of Adjustment. <br />2. Removing 3'+ from the front of the residence. <br />3. Moving the entire structure to the rear of the lot. <br />Alternative 2 would decrease the depth of the two car garage to <br />approximately 19'. While sufficient for parking many vehicles, <br />the 19' depth is inadequate for the installation of a wheel chair <br />ramp which may be needed in the future due to my wife's illness <br />(LUPUS). She is already legally handicapped. <br />
