addition to the rear to pick up the additional area.
STAFF RECOMMENDATION:
Staff recommends denial of the requested variance for the following
reasons:
1. The applicant has not demonstrated the existence of a physical
circumstance or condition which is unique to the affected property.
The setback requirement is not unique to the subject property.
Neither the area or configuration of the lot creates a unique
physical condition.
2. The applicant has not demonstrated that, if held strictly to
the zoning standards of the district in which it is located, the
property cannot yield a reasonable return of service or use
compared to adjacent conforming property in the same district.
3. The applicant has not demonstrated that a hardship has been
created due to the strict enforcement of the zoning standards.
The applicant has available options to construct an addition which
would not require a variance. An unnecessary hardship requires
that the physical characteristics of the property preclude a
reasonable use.
4. The variance, if authorized, would negatively impact the
established residential character of the subdivision which, in
part, has been created and maintained by the enforcement of the
established building bulk and setback requirements.
5. The variance request is not the minimum variance which will
afford relief, nor is it the least modification possible to the
provisions of this title.
2
