addition to the rear to pick up the additional area. <br />STAFF RECOMMENDATION: <br />Staff recommends denial of the requested variance for the following <br />reasons: <br />1. The applicant has not demonstrated the existence of a physical <br />circumstance or condition which is unique to the affected property. <br />The setback requirement is not unique to the subject property. <br />Neither the area or configuration of the lot creates a unique <br />physical condition. <br />2. The applicant has not demonstrated that, if held strictly to <br />the zoning standards of the district in which it is located, the <br />property cannot yield a reasonable return of service or use <br />compared to adjacent conforming property in the same district. <br />3. The applicant has not demonstrated that a hardship has been <br />created due to the strict enforcement of the zoning standards. <br />The applicant has available options to construct an addition which <br />would not require a variance. An unnecessary hardship requires <br />that the physical characteristics of the property preclude a <br />reasonable use. <br />4. The variance, if authorized, would negatively impact the <br />established residential character of the subdivision which, in <br />part, has been created and maintained by the enforcement of the <br />established building bulk and setback requirements. <br />5. The variance request is not the minimum variance which will <br />afford relief, nor is it the least modification possible to the <br />provisions of this title. <br />2 <br />
