to the moneys paid for the Property so taken by the condemning <br />authority. In the event of such a condemnation, the money so paid <br />by the condemning authority for the Property so taken shall be and <br />become the sole and separate property of the City. Additionally, <br />this Agreement shall terminate, both parties shall be released <br />herefrom, and all payments made by County to the City shall be <br />returned to County. The provisions of this Paragraph shall not be <br />construed as precluding or preventing the City or County from <br />condemning property which it is statutorily authorized to condemn. <br /> <br /> (B) If another governmental entity or agency excluding County <br />exercises its powers of eminent domain to acquire title to a <br />portion of the Property which County has the right to purchase <br />pursuant to this Agreement, County shall still retain the rights <br />granted herein as to such portion of the Property which is not <br />taken by the condemnation. In such event, the portion of the <br />Property which is not condemned shall remain subject to the terms <br />of this Agreement. The purchase price of the portion of the <br />Property remaining subject to this Agreement shall be determined on <br />a per acre basis. <br /> <br /> 20 Recording. Upon execution, this Agreement shall be <br />recorded in the office of the Clerk and Recorder of Boulder County, <br />Colorado. <br /> <br /> 21. Counterparts. This Agreement may be executed in any <br />number of counterparts, each of which shall be deemed an original <br />and all of which shall constitute one and the same agreement. <br /> <br /> 22. Governing Law. The validity and effect of this Agreement <br />shall be determined in accordance with the laws of the State of <br />Colorado. <br /> <br /> IN WITNESS WHEREOF, City and County have executed this <br />Agreement on the dates stated in their respective acknowledgments <br />intending that this Agreement be effective as of the day and year <br />first above set forth. <br /> <br />CITY OF LOUISVILLE, COLORADO, <br />A Statutory City <br /> <br />11 <br /> <br /> <br />
