to the moneys paid for the Property so taken by the condemning authority. In the event of such a condemnation, the money so paid by the condemning authority for the Property so taken shall be and become the sole and separate property of the City. Additionally, this Agreement shall terminate, both parties shall be released herefrom, and all payments made by County to the City shall be returned to County. The provisions of this Paragraph shall not be construed as precluding or preventing the City or County from condemning property which it is statutorily authorized to condemn. (B) If another governmental entity or agency excluding County exercises its powers of eminent domain to acquire title to a portion of the Property which County has the right to purchase pursuant to this Agreement, County shall still retain the rights granted herein as to such portion of the Property which is not taken by the condemnation. In such event, the portion of the Property which is not condemned shall remain subject to the terms of this Agreement. The purchase price of the portion of the Property remaining subject to this Agreement shall be determined on a per acre basis. 20 Recording. Upon execution, this Agreement shall be recorded in the office of the Clerk and Recorder of Boulder County, Colorado. 21. Counterparts. This Agreement may be executed in any number of counterparts, each of which shall be deemed an original and all of which shall constitute one and the same agreement. 22. Governing Law. The validity and effect of this Agreement shall be determined in accordance with the laws of the State of Colorado.
