Staff wanted to stay consistent for the entire city <br /> so no one business has an advantage over the other. <br /> Councilor Sackett commented the downtown sign code has been discussed by the <br /> BRaD Committee and received their support. <br /> Councilor Dalton inquired about the process of a request for a mural larger than what is <br /> allowed. Planning Director Russ explained a non conforming mural request would be <br /> reviewed by the Planning Staff, Planning Commission and requires City Council's <br /> approval. At this time no criteria has been created and Staff would work with the City <br /> Attorney to create new criteria for murals. <br /> City Attorney Light explained murals do not fit into the categories of special exception or <br /> the modification of a PUD as they are designed to deal with site plan issues. He agreed <br /> a mural is not advertising. There is a distinction between commercial speech, which is <br /> regulated by signage and the non- commercial, which can include a mural subject to <br /> certain limitations. The distinction is based on content. The revision gives a use by right <br /> based on non content criteria, without creating a moving timeline. <br /> Planning Director Russ clarified civic based events such as the Farmer's Market allow <br /> off premises signs. <br /> Mayor Sisk requested public comments and hearing none, closed the public hearing. <br /> MOTION: Councilor Muckle moved to approve Ordinance No. 1580, Series 2010 with <br /> the modification to add the word "historic" to the vision statement. Councilor Dalton <br /> seconded the motion. Roll call vote was taken. The motion carried by a vote of 6 -0. <br /> Absent: Councilor Clabots. <br /> PRESENTATION CITY MANAGER'S PROPOSED 2011 BUDGET AND <br /> 2011 -2015 CAPITAL IMPROVEMENTS PLAN SET PUBLIC HEARING TUESDAY, <br /> OCTOBER 19, 2010 <br /> Mayor Sisk requested a Staff presentation. <br /> City Manager Fleming presented the 2011 Proposed Budget for all funds both by <br /> programs and by individual funds. He also presented the 2011 capital projects included <br /> in the 2011 2015 Capital Improvements Plan. He outlined the guiding principles to <br /> balance the budget and reviewed the 2009 Budget focus areas, which included <br /> eliminating positions, not filling some vacancies and reducing hours; reducing <br /> compensation, benefits and training; significant service reductions and increasing fees <br /> and charges. <br />
