City Council <br /> Meeting Minutes <br /> November 16, 2010 <br /> Page 4 of 11 <br /> ORDINANCE No. 1581, SERIES 2010 AN ORDINANCE APPROVING THE <br /> VACATION OF AN EXISTING WATER LINE EASEMENT LOCATED WITHIN <br /> LOTS 102, 103, 134, 146 AND 147 PARKWOOD SUBDIVISION AND LOT 5, <br /> BLOCK 9 AND LOT 9, BLOCK 6, PARKWOOD FILING NO. 2, WITHIN THE <br /> CITY OF LOUISVILLE 2nd Reading Public Hearing <br /> Mayor Sisk requested a City Attorney introduction. <br /> City Attorney read Ordinance No. 1581, Series 2010. <br /> Mayor Sisk requested a Staff presentation. <br /> Planning Director Russ explained the Planning Department was approached by a <br /> homeowner in the Parkwood Subdivision requesting approval for a shed in the <br /> easement. This 16 -foot utility easement for a 16 -inch water line physically located 4 <br /> feet underground was platted in 1973 along with the subdivision. Director Russ stated <br /> he conferred with Tom Phare, Director of Public Works, who confirmed the water line <br /> had been abandoned in 1998, was filled with concrete and was no longer needed. <br /> Russ stated most of the easement runs under public right -of -way, however, there are <br /> seven lots where it is on private property and it is in the public interest to vacate the <br /> easement on those lots. <br /> PUBLIC COMMENT <br /> Mayor Sisk called for public comment. Florian Speier, 1104 Garfield Avenue, Louisville, <br /> CO stated he was the resident requesting the vacation of the easement and spoke in <br /> support of the ordinance. <br /> COUNCIL COMMENT <br /> Councilor Muckle commented this easement ends right behind his backyard so he felt <br /> there was no conflict. Mayor Sisk thanked Director Russ for the names of the property <br /> owners affected by this easement vacation. <br /> Mayor Sisk closed the public hearing. <br /> MOTION: Councilor Muckle moved to approve Ordinance No. 1581, Series 2010, <br /> seconded by Councilor Clabots. Roll call vote was taken. The motion carried by a vote <br /> of7 -0. <br /> RESOLUTION No. 70, SERIES, 2010 A RESOLUTION APPROVING EXCHANGES <br /> OF CONSERVATION EASEMENTS REQUIRED BY THE NORTHWEST PARKWAY <br /> INTERGOVERNMENTAL AGREEMENT (IGA) <br /> Mayor Sisk requested a Staff presentation. <br />
