City Council <br /> Meeting Minutes <br /> December 7, 2010 <br /> Page 4 of 10 <br /> ORDINANCE No. 1583, SERIES 2010 AN ORDINANCE AMENDING TITLE 17 OF <br /> THE LOUISVILLE MUNICIPAL CODE TO ADOPT AN ADMINISTRATIVE <br /> PROCEDURE FOR CERTAIN SPECIAL REVIEW USES AND PROVISIONS <br /> REGARDING LAPSE OF APPROVED SPECIAL REVIEW USES 2 Reading <br /> Public Hearing <br /> Mayor Sisk requested a City Attorney introduction. <br /> City Attorney Light read Ordinance No.1583, Series 2010. <br /> Mayor Sisk opened the public hearing and requested a Staff presentation. <br /> Planning Director Russ explained the Planning Commission and City Council directed <br /> staff to look at developing an administrative procedure for the current Special Review <br /> Use (SRU) process. The Louisville Municipal Code (LMC) does not provide an <br /> administrative review procedure for any of the SRU applications. All SRU's, regardless <br /> of scale and impact, must be processed through a public hearing process, which <br /> involves public meetings before the Planning Commission and City Council. The <br /> approximate length for this process is 60 to 90 days. <br /> Many SRU requests are noncontroversial and the public hearing process adds <br /> unnecessary delay in the development review schedule. The LMC currently allows <br /> administrative processes for Planned Unit Developments (PUD) and Temporary Use <br /> Permits. Planning Director Russ reviewed the Ordinance's proposed second reading <br /> amendments and the recommended seven criteria for Special Review Use (SRU) <br /> processes. <br /> COUNCIL COMMENT <br /> Councilors commented favorably on the proposed SRU process. There were inquiries <br /> about the notice period and suggested revisions to the notification process. City <br /> Attorney Light reviewed the proposed revisions to notification process. <br /> Mayor Sisk requested public comment and hearing none, closed the public hearing. <br /> MOTION: Councilor Muckle moved to approve Ordinance No. 1583, Series 2010 with <br /> second reading amendments, seconded by Mayor Pro Tem Marsella. Roll call vote was <br /> taken and the motion carried by a vote of 7 -0. <br /> RESOLUTION No. 73, SERIES 2010 A RESOLUTION TO RATIFY THE LOCATION <br /> AND APPROVE A SPECIAL REVIEW USE TO ALLOW FOR THE PLACEMENT OF <br /> AN ALTERNATIVE TOWER STRUCTURE FOR THE USE OF AN OMNI- <br /> DIRECTIONAL SIREN BASED EMERGENCY MASS NOTIFICATION WARNING <br /> SYSTEM FOR THE CITY OF LOUISVILLE ON THE CITY'S NORTH WATER <br /> TREATMENT PLANT PROPERTY LOCATED AT 1955 WASHINGTON AVENUE <br />
