South <br /> Boulder Road 3/14/10 Incident <br /> Chairperson Lipton opened the hearing. Special Prosecutor for the Authority, <br /> Kristin Brown, introduced herself to the Authority. Bob Dill, Attorney for licensee <br /> Beef "0" Brady's, introduced himself to the Authority. Both attorneys affirmed <br /> they were ready to proceed. <br /> Ms. Brown reported to the Authority there was a stipulation reached with the <br /> licensee. She outlined the terms of the stipulation. The Licensee would admit to <br /> a violation of Louisville Municipal Code §9.22.050 involving failure to immediately <br /> notify law enforcement of a disturbance at the licensed premises. All other <br /> alleged violations would be dismissed. The license would be suspended for a <br /> period of seven days with four days held in abeyance. The suspension would <br /> run concurrent with a suspension on the upcoming matter. <br /> Wilson objected to approving the stipulation item number 4, which addressed the <br /> suspension running concurrent with the other case. She suggested approval <br /> without that particular item until seeing the other stipulation. <br /> Carlson stated he believed there should be more days served. Lipton brought up <br /> paying a fine in lieu. <br /> Attorney Culley reminded the Authority there were items such as dates of <br /> suspension, gross revenues from the licensee, a petition from the licensee and <br /> acceptance of the stipulations to be resolved before a fine in lieu could be <br /> considered. <br /> Gunning asked what steps had been taken to make sure incidents like this did <br /> not re- occur. Tim Brasel, owner of the establishment, took the oath and <br /> answered questions from Mr. Dill about the failure to report and how he would <br /> approach it in the future. Mr. Brasel responded the employees had been <br /> instructed, and are reminded consistently, to call the police and not try to take <br /> matters into their own hands. <br /> Rommelfanger moved to accept the stipulation presented by the Special <br /> Prosecutor with the exclusion of item #4 concerning running concurrent with the <br /> next stipulation. Wilson seconded. Roll Call Vote: Rommelfanger yes, Wilson <br /> yes, Carlson no, Gunning yes, and Lipton yes. Stipulation accepted with <br /> amendment. <br /> Discussion by the Authority and Mr. Dill centered on the dates for suspension <br /> and the procedure surrounding payment of a fine in lieu. <br />
