Findings and Order Show Cause Hearing Village Square B "O" B
d /b /a Beef "0" Brady's Hotel and Restaurant Liquor License
585 E. South Boulder Road 3/14/10 Incident
Attorney Authority Light pointed the Authority Members to the Findings,
Conclusion and Order in the packet stating the suspension dates for the licensee
had been set for May 29, 30, and 31, 2010. Those dates were set after a 7 day
suspension was imposed and 4 days were held in abeyance. Staff members
confirmed the business is not in operation at this time. Attorney Light stated a
petition was received on the afternoon of the meeting asking the Authority to
consider a fine in lieu of suspension. Attorney Light asked the Authority to
confirm their intention in having the days of suspension served, in light of the
business being closed. Discussion centered on how to satisfy the disciplinary
action of the show cause. Lipton moved the Authority add language to
paragraph 3 of the Conclusion and Order stating "provided however that if the
Licensee is not in operation on May 29, 30, and 31, 2010, the suspension shall
be served on three days as determined by mutual agreement of the Licensee
and Authority secretary, but in no event later than December 31, 2010. Carlson
seconded. All in favor.
