RESOLUTION NO. 49 <br />SERIES 1999 <br /> <br />A RESOLUTION APPROVING A SPECIAL REVIEW USE AND <br />FINAL PUD DEVELOPMENT PLAN FOR <br /> THE OVERLOOK RESTAURANT ON <br /> LOTS 3 AND 4, BLOCK 1, THE BUSINESS CENTER AT CTC <br /> <br /> WHEREAS, there has been submitted to the Louisville City Council, a request for <br />approval of a Special Review Use and Final PUD Development Plan for The Overlook <br />Restaurant on Lots 3 and 4, Block 1, The Business Center at CTC; and <br /> <br /> WHEREAS, all materials related to the Final PUD Development Plan and Special <br />Review Use have been reviewed by City Staff and the Planning Commission and found, with <br />conditions, to be in compliance with the Louisville zoning ordinances, subdivision regulations, <br />related policies and previous approvals; and <br /> <br /> WHEREAS, after a properly noticed public hearing concerning said Special Review <br />Use and Final PUD Development Plan, the Planning Commission recommended approval to <br />the City Council, with conditions; and <br /> <br /> WHEREAS, the applicant has revised the application in response to some of the <br />Planning Commission's conditions and City Council finds that said Special Review Use and <br />Final PUD Development Plan should be approved, with the following conditions: <br /> <br />That the final design of the main pedestrian path, as it connects into the public sidewalk, <br />shall be subject to Public Works Department review and approval. This should be noted on <br />the PUD site plan; <br /> <br />That, if the proposed lO-foot grading and landscape easement is approved on the adjacent <br />lot to the east, that the proposed easement language shall be subject to City Administrator <br />review and approval prior to recording, and that recording of the easement shall occur <br />prior to or concurrent with recording of the PUD/SRU; <br /> <br />o <br /> <br />That details of the screen wall and gate shall be provided to verify the design is consistent <br />with the building architecture, including the use of stone, and that heavier landscape <br />plantings be provided adjacent to the wall, if determined necessary, subject to City <br />Administrator review and approval; <br /> <br />4. That one additional street tree be provided to the south of the southern of the two entry <br /> drives; <br /> <br />° <br /> <br />That some additional detailing and additional stone shall be added at the base of the south- <br />facing wall of the kitchen wing of the facility; <br /> 1 <br /> <br /> <br />
