determined to be in the best interests of the City, provided the essential terms of such Equipment <br /> Lease are not altered. The Mayor and City Manager, or either of them, and City Clerk, acting on <br /> behalf of the Lessee, are hereby further authorized to negotiate, enter into, execute, and deliver such <br /> other documents relating to the Equipment Lease as the Mayor or City Manager, upon advice of <br /> counsel, deem necessary or appropriate. <br /> Section 2. The Lessee's obligations under the Equipment Lease shall be annually <br /> renewable by the Lessee and expressly subject to annual appropriation by the Council, and such <br /> obligations under the Equipment Lease shall not constitute a general obligation of the Lessee or <br /> indebtedness within the meaning of the Constitution and laws of the State of Colorado. <br /> Section 3. The Equipment Lease does not create a multiple fiscal year direct or indirect <br /> debt or other financial obligation and does not require voter approval in advance under Section 4(b) <br /> of Article X, Section 20 of the Colorado Constitution. <br /> Section 4. The Equipment Lease will not cause the Lessee to exceed its spending limits <br /> under Section 7, Article X, Section 20 of the Colorado Constitution. <br /> Section 5. All other related contracts and agreements necessary and incidental to the <br /> Equipment Lease are hereby authorized. <br /> Section 6. The provisions of this Ordinance shall take effect 30 days after publication <br /> following final adoption pursuant to Section 4 -9(b) of the Louisville home rule charter. <br /> Section 7. If any portion of this ordinance is held to be invalid for any reason, such <br /> decision shall not affect the validity of the remaining portions of this ordinance. The City Council <br /> hereby declares that it would have passed and approved this ordinance and each part hereof <br /> irrespective of the fact that any one part be declared invalid. <br /> Section 8.
